Since TTWII 8 cd boxset has Get Back/Little Sister on both the concert cd and the rehearsal cd and we assume they are the complete versions, should this then also be true about the complete version of LIttle Sister/Get Back on the outtakes bluray release? Is there a difference with getting copyright permissions for a cd vs. video?
In short, yes, the permissions process is separate. Hopefully an agreement has been reached to allow for Get Back to appear on the DVD/BluRay releases.
But hey, if not they can always overdub a version of Don't Be Cruel!
The odd thing is that the "Get Back" rehearsal was included on that same 2007 DVD edition that edited out the "Get Back" live performance. You'd think the agreement for one would've sufficed for the other, but apparently not.
I'm listening to the rehearsal disc as we speak, and I have to agree with Matthew: this is not suited for a mainstream release. There are very few serious performances here. This is the kind of stuff that should be heard by FTD nerds only. On the other hand, I guess most people who buy this mega-set will be hardcore fans anyway. But still. It's not a particularly good listen. Obviously the producers choose these performances because they were, for the most part, not performed during the shows, in that sense I guess they are more interesting, but I for one won't play this CD again. Then again I never did like it when Elvis fools around with lyrics, sings with funny voices, laughs during songs, etc. Maybe others do.

I guess I'm confused as to why this rehearsal disc is not suited for a mainstream release when parts of it were already released mainstream on the Platinum boxset in 1997?
Even for the casual fan who may consider buying this, it's apparent that the cd you are referring to is a rehearsal one and not studio masters of the songs. I suppose if the person was looking for masters they probably would not have purchased this set anyway considering the number of concerts on each cd. I think this is an awesome release and can't wait to get mine! It's good to see a real picture of Elvis shown to the public of him in concert and rehearsing from 1970. And this is what Legacy releases have tried to present in many of their releases especially as was recently seen in the Elvis At Stax release showing studio masters with outtakes.

I am not against the inclusion of rehearsals per se, but I feel there are too many "loose" and "funny" performances on this set.

It's not that the recordings on the "rehearsals" disc are unsuitable for mainstream release, it's that the "rehearsals" disc is not actually demonstrative of any real rehearsing going on. It's mainly a compilation of all the loose jams and kidding around BETWEEN actual song rehearsals for the stage show.
It's very poorly compiled, the mandate obviously being to include as many different song titles on the set as possible.
Shame such shortsightedness has robbed the set of what could have been a very interesting disc.
