"Best Patriotic Song" Award

This year, the American Veteran Awards, a project of Veterans Foundation, Inc. has introduced a new award - the Elvis Presley "Best Patriotic Song" Award - at their 8th annual awards banquet, which took place in late November. It will be televised on the History Channel in February. The first Elvis award was presented to country duo Brooks & Dunn for their song Only in America.

The AVA contacted Graceland/EPE earlier this year to make us aware of their plans to name the award in honor of Elvis and ask our cooperation and assistance. Our thanks to the AVA for this wonderful recognition for Elvis and our congratulations to Brooks & Dunn for being the first recipient.

Brooks & Dunn could not be at the actual awards banquet in November when the Elvis Award was presented. They received their award on the set of CMT's Most Wanted Live program last Saturday. We'll post awards show airdate information when we have it. In the meantime, check out the American Veteran Awards web site.

Elvis comedy

British director Stephen Frears is considering making a new comedy about a conspiracy around Elvis Presley. Frears has directed the likes of High Fidelity and Dangerous Liaisons. He is expected to make The Importance of Being Elvis his next film. The film tells the story of Brian from Newcastle, who claims that for many years he was Elvis Presley. The premise is that when Elvis was serving in the US Army, he was shot in the throat by a fan and could no longer sing. His manager, Colonel Tom Parker, with the collusion of the American government, found an impersonator to replace him. It's not known when the film is likely to be made.

New Elvis DVDs In Canada

" The Definitive Collection " DVD set released by Passport Video in the USA this past Summer has just been released  in the French part of Canada. These are available right now in all major DVD and CD stores across Quebec. It was released in the USA as an eight DVD set but available in Canada in eight separate volumes with French subtitles during the interviews, and a French track on the voice over comments. This is titled " La Rétrospective Elvis - Vol.1 to Vol.8 " and region 1, NTSC. The artworks of each DVD volume are the same as the US ones but all written in French. This is not known at this moment if those DVDs were released at the same time all over Canada in a regular English version.

This Is Elvis On DVD

" This Is Elvis " might be released on DVD next year. It seems like David Wolper Producer has been working together with Jerry Schilling for a couple of months now on this release. This set should be a two DVD set which includes the standard, the 144 minutes version (Warner Brothers production) along with new unseen footage from this film 'This Is Elvis'.

Elvis Has Left the Courthouse

A Federal Appeals Court has issued an injunction barring the further sale of The Definitive Elvis, an unauthorized DVD collection of Elvis Presley material compiled and released by Passport Video, but the supplier plans to appeal the ruling.

"Passport will be filing an appeal of the lower court's decision to the United States Court of Appeals for the Ninth Circuit, and we are confident that the Ninth Circuit will reverse the order granting the preliminary injunction," the company said in a statement.

The suit against Passport Video and parent company Passport International was jointly filed by EPE, SOFA Entertainment, Leiber & Stoller, the Steve Allen Estate and other rights holders to Presley's work and image.

"It's a very important victory for these rights holders," said plaintiffs’ attorney George Hedges, of the Los Angeles-based law firm of Quinn Emanuel Urquhart Oliver & Hedges. "The defendant maintained that the use of copyrighted materials constituted fair use under the copyright laws. Our position is that their appropriation of the heart of these legendary performances constituted a classic case of copyright infringement. The plaintiffs are proceeding with our case for damages."

The Definitive Elvis features extensive use of images of Elvis Presley from television, film, live and recorded performances, as well as still images.

"A number of critics, both here and abroad, have called The Definitive Elvis the most important and comprehensive biographical documentary produced about the life of Elvis Presley,” contends the Passport statement. “Over 99 percent of The Definitive Elvis consists of original footage created and owned by Passport international. Over 230 interviews with the people in Elvis' life were conducted over a two-year period.”

The plaintiffs claimed victory nonetheless.

"We're pleased, obviously we feel vindicated," said Gary Hovey, VP of Entertainment and Music Publishing for Elvis Presley Enterprises, Inc. "Passport had taken the position that they could just take anyone's copyright work and use it without compensating the rights holder, which in our opinion is ridiculous. For someone to just take material is piracy."

Among the contested material used in the video set were Presley performances from the Ed Sullivan Show, owned by SOFA Entertainment. The set also includes several songs from the legendary songwriting team of Jerry Leiber and Mike Stoller, including "Jailhouse Rock," "King Creole," "Loving You" and "Girls, Girls, Girls," all allegedly used without permission.

"We are very pleased with Judge Lew's decision. Writing songs is our livelihood," Leiber and Stoller announced jointly. "Those who choose to steal rather than license our works have once again been put on notice that such actions are not only unacceptable - they are unlawful."

Passport attorneys contend that less than 1 percent of the material on the set is someone else’s copyrighted work and that is used to illustrate the documentary.

“Passport made very limited, transformative, and we think under the law, fair use of the less than 1 percent that constitutes plaintiffs’ copyrighted material,” the supplier stated. “For the Estate of Elvis Presley and the other plaintiffs to describe Passport's use of their material as 'unlawful' or 'piracy' under these circumstances is ludicrous and ignores the important First Amendment considerations present here.”

A New Record For The King

When his latest album ( 30 #1 Hits ) went to No. 1 on The Billboard 200, Elvis Presley became the artist with the longest span of chart-topping albums. "Elvis Presley" went to No. 1 the week of May 5, 1956, so the span between that album and "Elvis 30 #1 Hits" is 46 years, five months, and three weeks.

Before Presley claimed this record, it was held by the Beatles. Their span of No. 1 albums stretches from "Meet the Beatles," which reached the top the week of Feb. 15, 1964, to "1," which fell from pole position the week of Feb. 3, 2001, for a total of 36 years, 11 months, and two weeks.
